Owners are raising serious questions about governance, voting, financial transparency, property conditions, delayed repairs, the pool and other amenities, and whether they are receiving the rights and benefits connected to their ownership.

We are gathering owners’ firsthand experiences and reviewing the ESJ Towers bankruptcy proceedings, deeds, interval records, and other ownership documents to determine how particular units and ownership interests may be affected.

Your unit does not have to appear in a bankruptcy exhibit for your experience to matter. The bankruptcy is important, but so are the broader questions about how ESJ is governed, how owner money is used, how decisions are made, and what owners are receiving in return.

WHERE THE OWNER EFFORT STANDS

The Project has begun speaking directly with interested ESJ owners and gathering ownership records, firsthand accounts, and information concerning governance, voting, financial transparency, property conditions, amenities, and the bankruptcy proceedings.

The objective is to organize a sufficiently broad group of owners prepared to retain counsel, fund a coordinated legal engagement, and move into litigation posture if the facts and law support doing so.

We are now determining:

  • which owners want to participate;
  • what outcomes they want the collective to pursue;
  • what documents and evidence they possess; and
  • whether they are prepared to sign an engagement agreement and contribute to the collective legal fund.

What Owners Are Helping Us Understand

Owners are sharing experiences involving delayed repairs, the pool and other amenities, unavailable or substituted units, maintenance charges, voting, access to records, and confidence in property administration. These reports are being gathered and compared so that recurring concerns can be distinguished from isolated experiences.

No owner needs to have every document or know the legal significance of an event before speaking with the Project. Your firsthand experience is a useful starting point.


LEGAL AND OWNERSHIP DEVELOPMENTS

Reviewing the Bankruptcy and How Particular Units May Be Affected

On July 15, 2026, the Bankruptcy Court entered a supplementary order directing the Puerto Rico Property Registrar to record 1,255 intervals identified in the order in favor of Fortaleza ESJ, LLC. The Clerk issued the corresponding writ on July 23.

The court describes the identified interests as “deeded and unsold intervals” owned by ESJ Towers. The filed documents do not determine, owner by owner, the status of every privately claimed interest. Any potential effect on a particular owner requires review of that owner’s documents and circumstances.

Whether an owner’s unit appears on an exhibit does not answer the separate questions concerning governance, voting, financial transparency, property conditions, or owner benefits.

For nearly fifty years, ESJ owners have held deeds to real property in Puerto Rico. Those deeds convey more than an ownership interest—they carry rights concerning the governance, administration, and future of the Condominium.

Today, critical questions remain concerning who may vote, who speaks for the owners, how assessments and budgets are determined, and what happens to insurance, settlement, and other funds affecting the property. Proceedings continue in DACO and bankruptcy court while decisions affecting ESJ continue to be made.

The owners should not be absent from decisions about property they own.

WHAT WE ARE DOING

The ESJ Owners’ Restoration Project is organizing deeded owners so that their interests can be independently represented before critical decisions concerning ESJ become final.

The immediate objective is to identify and organize owners, evaluate and preserve their legal rights, and establish the representation and resources necessary to assert those rights where appropriate in Puerto Rico proceedings.

This includes issues involving owner governance and voting rights, insurance and settlement proceeds, assessments and financial accountability, and the preservation of deeded ownership interests.

The Project does not claim to be the Council of Co-Owners or speak for owners who have not authorized representation. Its purpose is to give owners the opportunity to organize, obtain independent counsel, and act together before their rights are decided without them.

Participation begins with identifying yourself as a deeded ESJ owner and telling us how you want to be involved.

Completing the Owner Interest & Representation Form allows the Project to verify ownership, understand the interests of participating owners, and communicate directly as the legal strategy develops.

MEET ORGANIZING COUNSEL

Erika D. Rodriguez is a Florida attorney whose practice includes real estate, complex civil litigation and consumer advocacy, with a focus on protecting clients whose property and financial rights are at stake.

After being retained by ESJ owners and examining the governing documents, ownership structure, and proceedings affecting the property, she identified a fundamental problem: deeded owners whose property and financial interests are directly at stake lack independent representation to protect their collective interests.

The ESJ Owners’ Restoration Project was created to change that—by organizing owners, developing the legal strategy, and building the representation necessary to protect their rights before critical decisions become final.

The owners remain the principals. Counsel’s role is to help them exercise the rights their ownership already gives them.
